20 years, and the patent protection period of pharmaceuticals and medical equipment can be extended within 14 years from the date of granted.

  • via Paris Convention : 12 months from earliest priority date.
  • via Nationalization of PCT : 30 months from the earliest priority date.

ILPO conducts formal and substantive examinations for patent applications. ILPO automatically examines the applications in the order in which they are received, and the applicant does not need to submit a separate request for substantive examination, nor does it need to pay any substantive examination fees. After passing through the substantive examination, a letter of granted will be issued. Within 3 months after the issuance of the letter of granted, if no one else raises an objection, the patent application will be officially granted. Applicants are required to submit an Information Disclosure Statement (IDS) and attach a list of all prior art prior to the granted.

The novelty grace period can be enjoyed 6 months from the filing date/priority date after the first disclosure if the following situations occur:

  • Disclosed by the inventor, patentee or his successor patentee.
  • Disclosed at an industry and agriculture trade show in Israel.
  • Disclosed at an internationally recognized exhibition (requires formal notification to ILIPO prior to the opening of the exhibition). 
  • Inventor notifies the patent office in advance, he will report at a scientific society or publish the contents of the report. 

3-5 years

  • Grant fee: The applicant shall pay the granted fee within 3 months after receiving the notification of granted.
  • Annuity: The applicant should pay the 1st annual fee (1-6 years) within 3 months after receipt of the notification of granted, and then pay the annual fee every 4 years, i.e., pay the annuity of 7-10 year in the 6th year from the filing date, the annuity of 11-14 year should be paid in the 10th year, the annuity of 15-18 year should be paid in the 14th year, and the annuity of 19-20 year should be paid in the 18th year, or all annual fees can be paid at one time.

Reinstatement of priority is accepted on grounds of "due care."

The term of protection is 5 years from the filing date and can be renewed 4 times for 5 years each time, up to a maximum of 25 years.

  • via Paris Convention : 6 months from earliest priority date.
  • via Hague Agreement route: 6 months from earliest priority date.

ILPO conducts formality examination and substantive examination for designs application. ILPO automatically examines the applications in the order in which they are received, without requiring the applicant to file a separate request for substantive examination and to pay fees. Pursuant to Article 38 of the Israeli Patent Law, the processing of the application must be completed within 12 months of the commencement of the examination. If the applicant fails to complete the examination within time limit due to the applicant's fault, the applicant will be deemed to be abandoned and the procedure will be closed.

If it is disclosed by the right holder or by a third party, no matter whether it is legal or not, the novelty grace period can be enjoyed within 12 months from the filing date/priority date.

  • Grant fee: None
  • Annuity: Annuity should be paid before the validity period of each 5 years expires, and the annual fee for the entire 25-year validity period of the design can also be paid in advance.

Each design application may contain only one design, with the exception of a set of articles, that is, two or more articles meeting the following conditions: they belong to the same class, and their visual characteristics differ only in non-material details (They share the same design), and they are often sold or intended to be used together. Such as: cutlery, chess pieces,etc. The fee for a multiple application is different from the fee for a regular design application.
