The novelty grace period is 12 months before the filing date/priority date.

IPOM conducts formality examination and substantive examination of the invention patent application, and the substantive examination starts automatically, and the applicant does not need to make a specific request.

A 12-month novelty grace period is available if the invention is disclosed by the applicant or its agent in any form of communication within one year of the filing date or priority date, or exhibited at a national/international exhibition. Appropriate evidence must be submitted at the time of application.

The initial period of protection is 6 years, which can be renewed twice, up to a maximum of 10 years.
