IGE/IPI conducts formal and substantive examinations of invention patent applications. The applicant does not need to file a separate request for substantive examination. There is a 6-month novelty grace period in Poland if the disclosure is caused by a third party in bad faith. Previously, there was no novelty grace period for patent applications in Polish IP legislation.

The novelty of the invention will not be lost if the information about the invention is disclosed within 6 months before the filing date or the priority date if the following conditions are met:

• Disclosure due to apparent misuse by the applicant or its predecessor owners
• The invention is disclosed at an official or officially recognized international exhibition

If the disclosure is caused by the inventor or the information source of the discloser is the inventor; or if the disclosure occurs again after being disclosed by the above-mentioned subject, the patent enjoys a novelty grace period within 12 months before the filing date/priority date.

A 12-month novelty grace period is available if the invention is disclosed by the applicant or its agent in any form of communication within one year of the filing date or priority date, or exhibited at a national/international exhibition. Appropriate evidence must be submitted at the time of application.

• Grant fee: The applicant shall pay the granted fee within 2 months after receiving the granted payment notice.
• Annuity: From the 3rd year from the filing date, the annual fee shall be paid year by year. For the application of PCT entering the national phase of Turkey, the maintenance fee before granted shall be paid. If the annual fee is overdue, it can be paid within a grace period of 6 months, and a 125% late fee will be paid at the same time.
