IPVN conducts formality examination and substantive examination of utility model patents. IPVN has no restrictions on the fields of utility model patent applications. Utility models can be applied for in all fields covered by inventions, but all utility models will undergo substantive examination. A patent applicant/anyone needs to file a substantive request no later than 36 months from the filing date.

• Grant fee: The applicant needs to pay within 4 months after receiving the announcement of the patent granted decision, and pay the annual fee at the time of granted at the same time.
• Annuity: The annual fee is paid year by year starting from the third year from the application date. Overdue annual fee can be paid within a grace period of 6 months, and a penalty of 0.5 euros should be paid at the same time.

The JPO conducts formality examination and substantive examination of invention patent applications. The applicant should submit a request for substantive examination within 3 years from the filing date. The JPO makes an granted decision if it determines after review that no grounds for refusal have been found.

INAPI conducts formal and substantive examinations of designs. After completing the formality examination, the applicant must extract the extract and publish it in the Official Gazette by INAPI within 60 working days. Any interested party can file an opposition to the patent application within 45 days after publication. Within 60 days after the end of the opposition period, no matter whether there is an opposition or not, the substantive examination fee must be paid and the payment voucher must be submitted to the Chilean Patent Office. PRV only conducts formality examination on design patents. After the design is officially submitted to the PRV, no modification or addition of other designs is allowed. An applicant may request a deferment of publication for up to 6 months from the filing date/priority date, and this request must be made at the same time as the new application is filed.
