A 12-month novelty grace period is available if the invention is disclosed by the applicant or its agent in any form of communication within one year of the filing date or priority date, or exhibited at a national/international exhibition. Appropriate evidence must be submitted at the time of application.

The PPO only conducts formality examination of utility model patent applications, only examines novelty and industrial applicability, and does not examine inventive step.

• Grant fee: The applicant should pay the granted fee within 6 months after receiving the patent granted decision, and pay the annual fee for the first to third years in one lump sum.
• Annuity: After granted, the annual annual fee should be paid within 6 months before the start of the next valid period. Overdue annual fees can be paid within a grace period of 6 months, but a 100% penalty must be paid at the same time.

Design: 5 years, renewable 4 times, 5 years each time, up to 25 years of protection.

• Grant fee: The applicant should pay the granted registration fee within 2 months after receiving the granted decision notice, and pay the annual fee for the first to third years at the same time.
• Annuity: Subsequent payment of annual fee every 5 years, overdue payment can be made within the grace period after 6 months, but a penalty must be paid at the same time.
