IPONZ conducts formality examination and substantive examination of invention patent applications. The applicant/anyone can submit a request for substantive examination no later than 5 years from the date of application. If there is a request for review, the substantive review cannot be carried out until the 5-year period expires.

INAPI conducts formal and substantive examinations of invention patent applications. Within 45 days after publication, any interested party can file an opposition to the patent application. Within 60 days after the end of the opposition period, regardless of whether there is an opposition, the substantive examination fee must be paid and the payment voucher must be submitted to the Chilean Patent Office; and specified in INAPI Experts in the technical field enter the stage of substantive examination. The DIP conducts formality examination and substantive examination of the invention patent application. The formality examination generally takes 1-1.5 years. After the completion of the preliminary examination, the patent application will be published and enter a 90-day opposition period. The applicant can only submit a substantive examination request within 5 years after the application is published, and the examination results of other countries such as Japan, the United States, the United Kingdom and Europe need to be provided to the DIP.

If within 12 months before the filing of the design patent application, due to the disclosure of the designer or its former right holder, the novelty grace period can be enjoyed.
