DINAPI conducts formality examination and substantive examination for invention patent applications. The applicant needs to reply within 60 days for the correction of the formality examination. After passing the formality examination, DINAPI will publish the application announcement. The announcement must be published by the applicant in two newspapers with large circulation, and publication will be continued for five days. Subsequently, DINAPI will publish the announcement in the monthly patent bulletin. If no opposition raised, the application will automatically enter into the substantive examination stage to determine whether the invention meets the requirements of novelty, creativity and industrial practicability, other patentability requirements stipulated by the law, and whether it meets the requirements of unity of invention. If the substantive examination fee is not paid within three years at the latest, the patent application will be deemed withdrawn. The application will be granted in the case that the requirements are met.

The novelty grace period is 12 months before the filing date/priority date.

  • Grant fee: The applicant needs to pay the granted fee after receiving the granted notice, and pay the 1st annual fee at the same time.
  • Annuity: The annual fee should be paid year by year starting from the 3rd year from the filing date. If overdue, the annuity can be paid within the grace period of 3-6 months. If it is paid within the 3-month grace period, the late fee will be 50%; if it is paid within the 6-month grace period, the late fee will be 100%.
