The SPO only conducts formality examination of the design patent application, which meets the requirements of formality examination and can be authorized after paying the registration fee.
A patent does not lose its novelty under any of the following circumstances:
- Within 6 months of the filing date/priority date, the patent has been disclosed as a result of apparent abuse by the applicant or its previous owner.
- The patent was disclosed at an international exhibition officially recognized by the Paris Convention Organization within 12 months of the filing date/priority date.
The design does not lose novelty if it is exhibited at an officially recognized international exhibition within 6 months of the filing/priority date, or if it is disclosed as a result of apparent misuse by the applicant or its previous owner.
