Under the current political situation in Yemen, trademark registration has been divided into two different jurisdictions: one is the national government in Sana'a, and the other is under the new legal government in Aden. As a result, the new trademark office in Aden will operate independently of the existing Sana'a trademark office. Therefore, it is recommended that companies apply for trademark registration in these two registries to ensure that their trademark rights are fully protected in Yemen.
Trademark application requirements in Sanaa
- Power of Attorney (POA): Must be authenticated by a Yemeni Consulate abroad and locally authenticated at the Ministry of Foreign Affairs, Department of Consular Affairs in Sana’a. This local authentication must be completed within 1 year after the power of attorney is authenticated by the Yemeni Consulate abroad, otherwise the Ministry of Foreign Affairs will refuse the local authentication.
- Proof of company registration: A simple copy of the company registration certificate or an extract from the commercial register must be provided, which must include the company name, address, date of establishment and scope of business. No notarization is required.
- Priority Document: If you claim priority, you must provide a certified copy of the priority document (original).
- According to the latest directives of the Yemen Trademark Registry, trademark applications must be submitted with electronic scanned copies of the required documents. As long as the name, address, legal status and scope of business of the applicant have not changed, one set of the above documents can be used for subsequent applications or any trademark matters of the same applicant.
Average registration time:
- Under normal circumstances, the average time from trademark application to registration is about 6-9 months.
Aden Trademark Application Requirements
In the Aden region of Yemen, due to the establishment of an independent trademark office, the requirements and procedures for trademark registration are somewhat different from those in Sana'a.
- Power of attorney (POA): It needs to be authenticated by the Yemeni Consulate. If the applicant has already registered a trademark in Sana’a, there is no need to re-apply for it. If there is no Yemeni Consulate in your country, the consulate of any Arab country can also provide authentication.
- Proof of Company Registration: The applicant company must submit a scanned copy of the company registration certificate or an extract from the business register, which must include the company's name, address, date of establishment and detailed business scope. The original is not required.
- Priority Document: If you claim priority, you need to provide a certified copy of the priority document. There is no time limit for submission and no additional fee is required.
For subsequent trademark matters by the same applicant, one set of documents can be used as long as the name, address, legal status and scope of business have not changed. Initially, a simple signed copy of the power of attorney and the company registration documents can be submitted, and then the original certified power of attorney can be submitted within 30 days of the application date. During the registration process, the necessary trademark search is first carried out, and then the trademark is submitted after receiving the simple signed power of attorney. According to the requirements of the Trademark Registry, a statement must be attached to confirm that the trademark applied for is authentic and not an imitation of a third party's trademark. In addition, an additional official fee of 30,000 Yemeni riyals must be paid for the Trademark Office to review the Arabic translation of all supporting documents.
Average registration time:
- Under normal circumstances, the average time from trademark application to registration is about 6-9 months.
