  • via Nationalization of PCT : 31 months from earliest priority date.
  • via Paris Convention : 12 months from earliest priority date.

RIP conducts formality examination and substantive examination for invention patent applications. If the formality examination fails to meet the requirements, the Patent Office will notify the applicant to make corrections within 15 working days. If applicant failures to make corrections on time, the application will be considered to be withdrawn. After passing through the formality examination, the applicant shall pay the publication fee within 1 month. Costa Rican patent applications will be published in the Patent Gazette for three days, and applicants can also apply for early publication. Anyone can file an opposition within 3 months of publication. The Patent Office will notify the applicant of the opposition and the applicant requires to respond within 1 month. After the opposition period, the patent application in Costa Rica enters the substantive examination stage, and the patent will be granted if the application meets the requirements of grant. In most cases, the RIP will issue only one office action during the substantive examination stage.

2-3 years

  • Grant fee: The applicant needs to pay the granted fee when receiving the granted notice.
  • Annuity: The applicant needs to pay the annual fee for the 2nd year within 2 months from the date of issuance of the granted notice. The payment can be postponed within 6 months after the overdue period, but a penalty of 30% of the annual fee of the current year must be paid at the same time. You can pay the annual fee for more than two years at one time.
