  • via Paris Convention: 12 months from earliest priority date.
  • via Nationalization of PCT: 31 months from earliest priority date.

IPO CZ conducts formality examination and substantive examination for invention patent applications. The formality examination conducts including: whether the subject matter is obviously unpatentable subject matter, unity issues and whether it contains defects that prevent the publication of the patent. The applicant/anyone may file a request for substantive examination, no later than 36 months from the filing date/priority.

If it is displayed at an officially held or recognized international exhibition, or is maliciously disclosed by a third party who takes advantage of the relationship with the inventor and its original right holder, it is entitled to a novelty grace period of 6 months before the filing date/priority date.

4-5 years

  • Grant fee: The applicant shall pay the granted official fee within 3 months after receiving the granted notice.
  • Annuity: Annuity should be paid starting the 1st year from the filing date and paid within 3 months after receiving the granted notice. The annual fee for the next year should be paid before the validity period expires. If overdue, annuity can be paid within the grace period of 6 months and no penalty will be incurred.

Restoration of priority will not be accepted.

IPO CZ conducts formality examination and substantive examination for the design patent application. The substantive examination is automatically started when the design application is filed, and no separate request for substantive examination is needed to be filed by the applicant. IPO CZ only conducts novelty search.
