  • via Paris Convention : 12 months from earliest priority date.
  • via Nationalization of PCT : 31 months from earliest priority date.

IPOM conducts formality examination and substantive examination for the invention patent application. The substantive examination starts automatically, and the applicant does not need to file a spareate request.

1-1.5 years

  • Grant fee: The applicant should pay the granted fee within 6 months after receipt of the notification of granted, and pay the annual fee for the 1-3 years simultaneouly.
  • Annuity: The annuity should be paid within 6 months before the start of the next valid period after granted. If overdue, the annuity can be paid within a grace period of 6 months, but a 100% penalty must be paid at the same time.

IPOM accepts the restoration of the right of priority. Please consult IPOM about the applicable standards and/or charges.

Yes. An invention patent application can be converted from an Invention to a Utility Model before the granted, and the filing date of the original application shall be the filing date of the converted patent application.
