  • via Paris Convention : 12 months from earliest priority date.
  • PCT filing route: 30 months from the earliest priority date.

SPO conducts formality examination and substantive examination for the invention patent and SPO will publish the application after the formality examination is passed. The applicant needs to pay the fee for the substantive examination within 3 months after receiving the notification of payment, then substantive examination will start. The duration for examination depends on the complexity of the application.

A patent does not lose its novelty under any of the following circumstances:

  • Within 6 months of the filing date/priority date, the patent has been disclosed by the applicant or its previous owner.
  • The patent was disclosed at an international exhibition officially recognized by the Paris Convention Organization within 12 months of the filing date/priority date.

3-5 years

  • Grant fee: The applicant should pay the granted fee within 90 days after receipt of the notification of granted. 
  • Annuity: The annuity should be paid year by year from the 2nd year from the filing date. It needs to be paid between January 1 and March 31 of each year. If overdue, it can be paid within the 3-month of grace period and doubled penalty. 

Restoration of priority is accepted on the grounds of "due care" and "unintentional/due care".
