TIPO conducts formality examination and substantive examination of design patent applications, and the request for substantive examination must be filed within 3 years from the filing date/priority date.

• Annuity: The applicant should pay the first annual fee at the beginning of the 5th year from the application date. DKPTO conducts only formality examination of utility model patent applications. It can be submitted in a foreign language, but the Danish translation must be completed within one month from the filing date. The applicant/anyone can submit a request for examination during the validity period of the patent, and DKPTO will conduct substantive examination after paying the corresponding fee. Taiwan is not a signatory to the Paris Convention and the Patent Cooperation Treaty. After Taiwan's accession to the WTO, the issue of priority protection for international applications was resolved. Priority may be claimed within 12 months from the priority date if the foreign application was filed in a WTO member state. If the foreign applicant is not a citizen of a WTO member state, but has an office or residence in a WTO member state, he can also claim priority in Taiwan. After the patent application is submitted, TIPO conducts formality examination and substantive examination of the patent application. The formality examination does not conform to the prescribed procedures and there is nothing that should not be disclosed, and it will be published 18 months after the filing date. Within 3 years after the date of application for a patent for invention, anyone can apply for substantive examination and enter the stage of substantive examination. After the invention patent application has passed the substantive examination, the patent granted can be obtained.

DIP only conducts formality examination for utility models, and the documents can be authorized if they meet the formality examination standards. If litigation or evaluation of the stability of utility model Claim is required, the applicant may submit a request for substantive examination within one year after the granted announcement.

The application does not lose novelty if it is disclosed within 12 months from the filing date/priority date by the applicant, inventor, agent, or a third party or state agency that has obtained information from the above-mentioned persons.
