Designs with a filing date after March 10, 2022, where the first disclosure occurs after that date due to:

• Inadvertently making a design public
• Didn't know the design needed to apply for protection before it was disclosed

A design patent application can enjoy a novelty grace period of 12 months.

If the patent is disclosed due to the display at the exposition or unintentional disclosure, the novelty grace period can be enjoyed within 6 months before the filing date/priority date.

The initial period of protection is 6 years, which can be renewed twice, up to a maximum of 10 years.

via Nationalization of PCT : 31 months from the earliest priority date (this period may be reinstated: (i) 2 months after the factors preventing the applicant from filing an application for national phase entry have ceased; or (ii) when an application for national phase entry can be filed within 12 months after the end of the 31 months);

via Paris Convention : 12 months from the earliest priority date (priority cannot be restored);

A patent does not lose its novelty under any of the following circumstances:

• Within 6 months of the filing date/priority date, the patent has been disclosed as a result of apparent abuse by the applicant or its previous owner.
• The patent was disclosed at an international exhibition officially recognized by the Paris Convention Organization within 12 months of the filing date/priority date.
