Introduction to Danish Trademark Registration

The trademark law currently implemented in Denmark is the Trademark Law which came into effect on January 24, 2012. There are three ways to obtain trademark protection in Denmark, namely the single national registration route, the European Community Trademark Registration (CTM) route, and the Madrid route. Denmark is also the only country in the EU that can use trademark rights independently. In Denmark, you can apply for word trademarks, graphic trademarks, logo trademarks, location trademarks, pattern trademarks, color trademarks, sound trademarks, sports trademarks and series for words, names, devices, three-dimensional shapes, slogans, colors, sounds, and trade dress. Trademarks, collective marks, certification marks and service marks can also be applied for. In Denmark, you can apply for a trademark in multiple categories. Danish trademark applications are also available in Greenland and the Faroe Islands.

There is no need to submit a priority document when filing a trademark application in Denmark, however, priority information needs to be included in the application.

5. Danish trademark registration application process

  • After applying for Danish trademark registration, the DPTO will first conduct a formal review, and then review the trademark on absolute grounds and relative grounds. The review on relative grounds includes searching for Danish trademarks, EU trademarks and international trademarks that may cause confusion, and applying to the trademark based on the review results. Provide search reports. The DPTO will only issue a notice of rejection of a trademark application if there are absolute grounds.

9. Authorization, validity period and trademark renewal

  • Denmark does not charge licensing fees. As of January 1, 2019, trademarks in Denmark are valid for ten years from the date of application and can be renewed for ten years. The ten-year validity period of trademarks registered before January 1, 2019 is still calculated from the date of registration. The prescribed fee should be paid to the Patent and Trademark Office within six months before the expiration of the registration period or within the six-month grace period before applying for renewal.
