via Paris Convention : 12 months from earliest priority date.

IPO-Pakistan conducts formality examination and substantive examination (technical examination) for invention patent applications. The applicant does not need to submit a specific substantive examination request, and the examination process starts automatically; the administrator of IPO-Pakistan submits the complete application documents to the examiner for formality examination and technical review, and convey the review opinion to the applicant in accordance with regulations. This process usually takes 8-10 months from the filing date. After the applicant completes the reply, if the administrator agrees, the invention patent application will be accepted and published. If there is no objection within 4 months after publication, the patent application will be granted. Within 30 days of receiving the granted notice, the applicant needs to send a copy of the abstract of the invention patent to 22 institutions in Pakistan.

A 12-month novelty grace period is granted if disclosed at an officially recognized exhibition within 12 months of the filing/priority date.

1.5-2 years

  • Grant fee: The applicant should pay the granted fee within 4 months after receipt of the notification of granted.
  • Annuity: The applicant should pay the 1st year of annuity in the 4th year from the filing date/priority date. Overdue payment can be made within 6 months after the due date, and a penalty must be paid at the same time. If the 6-month period is missed and the fee is not paid, the patent will become invalid.
