Ukrainian patent application fees rise

Starting from September 16, 2023, Ukraine will start to use a new intellectual property fee schedule. According to the revised fee schedule, the following fees have been adjusted:

  • The objection request fee has been increased to 6,000UAH (Ukrainian hryvnia).
  • SPC's maintenance fee for years 1-5 increased from 30,000UAH to 38,000UAH, an increase of approximately 27%.
  • The period for appointing a Ukrainian agent for foreigners or stateless persons was extended.
  • The fee for filing a request to extend the validity period of industrial design rights has increased to 800UAH.
  • The application fee for divisional applications for inventions and utility models is increased to 800UAH.
  • For industrial designs that require changes to the industrial design application due to divisional applications, the amendment fee is increased to 800UAH.
  • The new application filing fee for design patent applications has increased to 6,800UAH.
  • The fee for patent search is increased to 3,000UAH.
  • The fee for filing an invalidation request for invention, utility model or industrial design rights has been increased to 32,000UAH.
  • The trademark appeal fee is increased to 24,000UAH.

The new fee standards also include fees for relinquishing all or part of the rights to an invention or utility model, as well as fees for reinstating claims if payment conditions are missed.

In addition to the introduction of the new fee scale, as a further response to the current situation in Ukraine, a new extension of the EUIPO deadline on Ukrainian intellectual property matters came into effect. All deadlines between September 15, 2023 and November 15, 2023 (inclusive) can be extended to November 16, 2023. A request for an extension of time for an examination opinion may be submitted to all parties who are resident in Ukraine or have a registered office in Ukraine.

In addition, EUIPO signed a Memorandum of Understanding (MoU) with the newly established National Agency for Intellectual Property and Innovation of Ukraine (UANIPIO), aiming to consolidate Ukraine’s IP system and benefit IP applicants.
