Peru launches fast-track examination program for green patent applications

On May 2, 2024, the Peruvian Intellectual Property Office INDECOPI launched the "Accelerated Green Patent Program", which aims to shorten the authorization time for eligible patent applications from 4-5 years to 8-11 months, and stimulate the development of green technology in Peru through sustainable innovation patent applications.

Based on the requirements of INDECOPI, patent applicants must mark their applications in accordance with the International Patent Classification (IPC) of the World Intellectual Property Organization (WIPO) when submitting their applications.

In addition, it is required that:

  • The patent application must have been published, the deadline for filing opposition requests must have passed, and the substantive examination fee must have been paid.
  • Applicable to invention and utility model patent applications filed after January 2, 2023, including PCT applications and divisional applications in the national phase.
  • The applicant must also submit a statement explaining why the patent application falls within the field of green, pollution-free or ecologically sustainable technology.

The simplified and expedited examination process is expected to encourage applicants to file patents in areas such as renewable energy, waste management and energy efficiency, increase the competitiveness of Peruvian companies in the global clean technology market, and directly contribute to the country’s sustainable economic and social growth.”

Other countries with fast-track options for green technology patents include Australia, Brazil, Canada, China, Israel, Japan, South Korea, Taiwan, the United Kingdom and the United States.
