  • via Paris Convention : 12 months from earliest priority date.
  • via Nationalization of PCT : 30 months from the earliest priority date.
  • via Validation of European Patent in EPO member states: within 3 months from the date of grant of the European patent.

ZIS conducts formality examination and substantive examination for invention patent applications. Based on the applicant's request and fees, ZIS initiates the prior art search and issues a search report accordingly. The applicant also needs to file a request for substantive examination within 6 months after the publication of the search report.

A novelty grace period is available if the disclosure of the invention, which became part of the prior art within the six months preceding the filing of the application, resulted from:

  • Disclosure resulting from misuse by the applicant or its original right holder.
  • Publicized by the applicant or its original rights holder at an official or officially recognized exhibition, and the exhibition complies with the provisions of the Paris Convention.

4-5 years

  • Grant Fee: The applicant needs to pay the grant fee within 10-15 days after receiving the granted notice.
  • Annuity: It shall be paid year by year from the 3rd year from the filing date, and shall be paid in full in the month of the date of application each year. If the annuity is overdue, it can be paid within a grace period of 6 months, and 50% of the annuity of the current year is required to be paid as a penalty.

  • via Paris Convention : 6 months from earliest priority date.
  • via Hague Agreement: 6 months from earliest priority date.

The ZIS conducts formal and substantive examination of design patent applications. For the deficiencies in the form examination, the applicant shall reply and make corrections within one month. The applicant does not need to submit a request for substantive examination, and the substantive examination starts automatically. ZIS examines the novelty and uniqueness of the design. If the granted conditions are met, the granted will be granted after the applicant pays the granted fee.

A novelty grace period applies if the disclosure occurs within 12 months of the filing date or priority date.

  • Grant fee: The applicant shall pay the grant fee within 10-15 days after receiving the grant notice.
  • Annuity: The annuity for the first five-year period is paid in one lump sum at the same time as the grant fee. Subsequent annuity (6th year to 25th year) should be paid within 6 months before the validity period expires. If the annuity is overdue, it can be paid within a grace period of 6 months, and 50% of the annuity of the current year is required to be paid as a penalty.
