New rules for injunctive relief for intellectual property infringement in Poland

In intellectual property disputes, injunctions as a remedy procedure are extremely important. Obtaining an injunction often enables IP rights holders to prevent new competing products and prevent infringers from taking over the market. Poland is the EU's fifth-largest economy, with around 40 million consumers, and a growing number of products launched in Central and Eastern Europe start in Poland.

Poland will introduce specialized intellectual property courts, with a total of five regional courts and two appeals courts, which will only deal with intellectual property rights and unfair competition. Polish intellectual property courts can issue injunctions before or during proceedings. When granting injunctive relief, Polish IP courts can decide to prohibit a potential infringer from acting in a certain way. If a potential infringer loses a dispute, a specific amount will be "frozen".
