Newly revised New Zealand Patent Examination Guidelines
Recently, the New Zealand Intellectual Property Office has made major changes to the claim limitations of the parent case and divisional cases mentioned in Section 82 of the Patent Act. The "overlapping" of the claims of the parent case and the divisional case as stipulated in the original regulations is further clarified as "substantially identical".
This revision reflects the review practice of the claims of parent cases and divisions, and clarifies the scope of claims that this provision applies to in parent cases and divisions.
