Milan replaces London as central court branch of the European Unified Patent Court (UPC)

In response to the impact of Brexit and the withdrawal of the European Unified Patent Agreement (UPCA), the Administrative Committee of the European Unified Patent Law (UPC) passed the amendment to Article 7, item 2, of the UPCA on June 26, 2023, and will be based in London. The branch of the Central Court was renamed Milan, Italy, and the allocation of cases to the branches of the Central Court in Appendix II of the UPCA was also modified:

  • The Milan Central Court Branch will be responsible for Category A litigation in the IPC classification, that is, litigation that is necessary for human life but does not include a Supplementary Protection Certificate (SPC);
  • The Paris Central Court Branch is responsible for litigation of categories B, D, E, G, H and Supplementary Protection Certificates (SPC) in the IPC classification, namely operations, transportation, textiles, papermaking, fixed buildings, physics, electricity, etc. litigation;
  • The Munich Central Court is responsible for Category C and Category F litigation, but does not include litigation related to Supplementary Protection Certificates (SPC), namely: litigation in chemistry and metallurgy, mechanical engineering, lighting, heating, weapons, blasting, etc.
