Argentina launches design and trademark DAS service

The Argentine Trademark and Patent Office will implement Resolution 262/2023 starting from September 1, 2023, which stipulates that Argentina can serve as an access office to receive DAS query requests from foreign applicants, and starting from November 1, 2023, Argentina’s own Applicants may also submit a DAS deposit request.

However, for Chinese applicants and other non-Spanish language patent applicants, it is still important to note that patent applications filed in Argentina still require an affidavit from the Argentine translator, which is the Argentine Trademark and Patent Office’s priority policy. It is a mandatory requirement, therefore, that if the priority text of the patent application is not in Spanish, a Spanish translation of the priority must be provided, as well as an affidavit of the native Argentine translator.

Since Argentina is not a country under the PCT system, Chinese applicants can only submit patent applications to Argentina through the Paris Convention.
