Indonesian Intellectual Property Office DGIP and Korean Intellectual Property Office KIPO signed a PPH bilateral agreement

Ten years after signing a Patent Prosecution Highway (PPH) Memorandum of Understanding with the Japanese Intellectual Property Office JPO in 2013, Indonesia signed another important PPH Memorandum of Understanding with South Korea on September 8, 2023.

Through the PPH mechanism, patent applicants can expedite the examination process of their patent applications in Indonesia. This accelerated examination mechanism is achieved by utilizing substantive examination results issued by national patent offices that have established PPH memorandums of understanding with the Indonesian Directorate of Intellectual Property (DGIP), specifically the Korean Intellectual Property Office (KIPO) and the Japanese Patent Office (JPO). Without a PPH, the substantive examination process usually lasts approximately 2 years from the date of application submission until the substantive examination results are received. However, with the PPH accelerated review mechanism, the 2-year review period can be shortened to 6 months (calculated from the date of submission of the PPH request). This acceleration significantly reduces the overall time frame of the patent application and registration process.

Applicants can submit a PPH request through Indonesia’s Patent Electronic Application System immediately after the application is published and before the first office action is issued.

The PPH program shows the Indonesian government’s real support and commitment to promoting Korean and Japanese investment in Indonesia.
