The Patent Cooperation Treaty (PCT) pilot project jointly carried out by the European Patent Office (EPO) and the China National Intellectual Property Administration (CNIPA) has entered a new phase. From December 1, 2024, Chinese applicants who designate the EPO as an international search authority will be able to pay search fees in RMB, which greatly facilitates Chinese applicants.
On December 1, 2020, the EPO allows fees to be paid in RMB, which simplifies the application process for Chinese applicants and makes it easier for them to obtain high-quality international search reports and written opinions provided by the EPO.
The new pilot project will enable applicants who choose the EPO as their ISA to obtain European patent protection faster. If the applicant files an international preliminary examination under PCT Chapter II, the EPO's examination fees can be reduced by 75%, and there is no need to supplement the European search or translate the PCT application when entering the European national phase, thus saving applicants time and money.
The quota for this new phase of the pilot program is 3,000 applications per year.
