1. Changes in application fees

  • The USPTO previously offered two different application options: TEAS - $250, and TEAS Standard - $350. Starting in 2025, applicants will no longer have to choose between these two options, but will only have to pay a single standard fee for the basic application, which will be $350 per class of trademark registration. The fee for filing a trademark registration application under the Madrid Protocol has increased from $500 per class to $600. In addition, to help improve the efficiency of the review, the USPTO will also add a surcharge of $100 per class to the trademark registration application fee for incomplete information or insufficient information to support the review.

2. New Fee Standards for Product and Service Descriptions

  • The USPTO will begin charging additional fees to applicants who wish to customize their descriptions of goods and services to avoid lengthy and unique descriptions that would take up a significant amount of examiner time. Applicants will be charged:
    (1) List the goods and services using a free-form text box. If the applicant does not use the pre-approved descriptions in the Trademark Manual, a fee of US$200 per class will be charged;
    (2) For each class description, after the first 1,000 characters used, a fee of US$200 will be charged for each class.
    This change marks a significant departure from current practice and will likely result in significant increases in fees associated with trademark applications that provide for nuanced and/or extensive descriptions of goods and services.

3. Increase in trademark use declaration fees

  • The USPTO is increasing fees for declarations of intent to use a mark, as well as voluntary amendments to declarations of use, from $100 per class to $150 per class.

4. Increase in trademark renewal fees

  • The USPTO will also increase fees for trademark renewals and related required record keeping maintenance.
