In a Norwegian patent application, if the applicant misses the deadline, the applicant may file a request for "further processing" within 4 months from the original deadline, and NIPO will issue an invoice for the request for restoration of rights. The request for restoration of rights applies to the following matters:
- Missed the annual fee payment deadline
- Missed the restoration deadline and restoration fee payment deadline
- Missed deadline to file an appeal with the Industrial Property Appeal Board
- Missed the deadline for paying the fee for further processing
- Missed the validity period of the European patent and the validity fee payment deadline in Norway
- Missed deadlines for entering the Norwegian national phase of a PCT application, missed deadlines for paying national phase entry fees, and late deadlines for submitting English translations
- Restoration of priority
- Missed deadline to respond to NIPO letter
The request for restoration of rights must be made to NIPO in writing, accompanied by an "unintentional" statement that the missed deadline was not intentional. In addition, the applicant must complete other actions that were missed within the original deadline, such as completing the response, completing the payment, etc.
- The request for restoration of rights must be filed with NIPO within 2 months of the applicant becoming aware of the missed deadline, and at the latest within 12 months of the original deadline.
- Restoration of rights request fee: NOK 3000
- Post-grant opposition: Anyone can file a written opposition to a patent application within 9 months from the date of grant, free of charge. Even if the opposition period has passed, anyone can still file a written request for patent administrative reconsideration to appeal.
- The patent owner can file a restrictive injunction against the patent application 9 months after the grant, the official fee is NOK 7000
