Accelerated Examination Channel in the Peruvian Patent Application Process

On May 2, 2024, the Peruvian Intellectual Property Office INDECOPI launched the "Accelerated Green Patent Program", which aims to shorten the authorization time for eligible patent applications from 4-5 years to 8-11 months, and stimulate the development of green technology in Peru through sustainable innovation patent applications.

Patent applications for green technology accelerated examination procedures must meet the following conditions:

• The patent application must have been published, the deadline for filing oppositions must have passed, and the substantive examination fee must have been paid
• Applicable to invention and utility model patent applications filed after January 2, 2023, including PCT national phase applications and divisional applications
• The applicant must also submit a statement explaining why the patent application falls within the field of green, pollution-free or ecologically sustainable technology.
