On April 16, 2025, the Ukrainian parliament passed a new law that repeals the special wartime intellectual property rules enacted in 2022. These rules temporarily suspended various deadlines and extended the validity period of intellectual property rights during the war. The new law will take effect 30 days after its official publication after the president signs it.
Once the new law goes into effect, all deadlines that were suspended during the war will restart. Each deadline will be re-enacted based on the time that had passed before it was suspended. In any case, there will be at least a 75-day grace period for each case. Any IP action or fee paid during this grace period will be considered timely. This includes:
- The new law is expected to take effect within 1-2 months.
- Once effective, standard deadlines for patent validity, trademark oppositions, fee payment deadlines, document submissions and annual fee renewals will restart.
- Intellectual property rights extended under wartime rules will expire unless promptly maintained
- Ukrainian Intellectual Property Office to reopen pending applications and delayed opposition requests
- The 75-day grace period will allow IP holders to file and pay fees without penalty
