The Intellectual Property Department of Myanmar (IPD) has just announced that the “New Industrial Design Law 2019” will officially come into effect on October 31, 2023.
Operation date:
- At present, the relevant guidance regulations, relevant design forms and official charging standards of Myanmar’s new industrial design law have not yet been released. Therefore, there may be no new design applications on the date when the new industrial design law takes effect. The running date for submitting new applications is expected to be slightly later.
Summary:
- The initial protection period for a Myanmar design is 5 years from the date of application, and can be extended twice in a row, each time for 5 years, and the protection period can be up to 15 years.
- Myanmar’s industrial designs will be subject to substantive review
- The appearance design requires novelty.
