Myanmar officially releases patent application fee standards

On October 22, 2024, the Myanmar Intellectual Property Office issued Notice No. 2/2024, announcing the official fee standards for invention and utility model patent applications. The official fees range from 500,000 Myanmar Kyats/(about US$250) to 1,500,000 Myanmar Kyats (about US$750), and the Myanmar Intellectual Property Office will officially accept invention patent and utility model patent applications from October 31, 2024. Applicants can now submit patent applications to the IPD electronically or by mail.

in:

• Application fee: 500,000 Myanmar Kyats, including 5 claims and 20 pages of patent application specification
• Claims surcharge: If there are more than 5 claims, an additional fee of 20,000 Myanmar Kyats will be charged for each claim starting from the 6th claim.
• Instruction Manual Surcharge: If the instruction manual exceeds 20 pages, an additional fee of 3,000 Myanmar Kyats will be charged for each page of the instruction manual

The Myanmar Patent Law was promulgated on March 11, 2019. It is also the first legislation in Myanmar's history specifically for patent protection. It will be officially implemented on May 31, 2024. However, Myanmar currently does not accept applications for patents or utility models through the Patent Cooperation Treaty (PCT), nor does it accept priority claims under the Paris Convention. However, applicants can claim priority based on applications filed by World Trade Organization (WTO) member countries within one year from the date of the prior application of the invention.
