The Brazilian government has notified the World Intellectual Property Organization that, in accordance with Article 8, paragraph 7, of the Madrid Protocol, the amounts of individual designation fees in Brazil will be adjusted. From August 9, 2025, the amounts of individual designation fees in Brazil will be as follows:

  • CHF 61 (Part I) and CHF 109 (Part II) for each class of goods or services when Brazil is designated in the international application or when Brazil is designated subsequently
  • 146 Swiss francs for international registrations designating Brazil at the time of renewal, the fee is 146 Swiss francs per class of goods or services. If paid within the grace period, the fee is 292 Swiss francs per class

Starting September 20, 2025, the fee for designating Brazil will be changed to a one-time payment of the following amounts:

  • CHF 251 for each class of goods or services when designating Brazil in an international application or subsequent designation;
  • 146 Swiss francs for renewal of an international registration designating Brazil. 292 Swiss francs per class if paid within the grace period.

✅The payment mechanism reform prompts the "cost control window"
From August 9 to September 20, 2025, you can still submit an application or designate Brazil in two parts, with a total fee of 170 Swiss francs (61+109). However, after September 20, the fee will be adjusted to a one-time payment of 251 Swiss francs. This change provides companies with a time window to save about 40% of costs, which is a "Madrid application node" worth seizing.

✅The entry threshold of the Brazilian market is rising
Although the one-time payment mechanism has simplified the process, it has also raised the entry threshold. Especially for small and medium-sized brands that intend to test the emerging markets, the high fee of 251 Swiss francs for each category of goods may limit the flexibility of multi-category strategies. It is recommended that Chinese applicants set up detailed strategies for priority and category configuration for individual countries such as Brazil when formulating Madrid trademark strategies.

Dynamic adjustment of individual fees should be included in the budget system
Brazil's change is not an isolated case. In recent years, many Madrid member countries including Japan, India, Mexico, and the Philippines have adjusted individual fees. This puts forward new requirements for both enterprises and service agencies - not just focusing on "registration success", but establishing a dynamic fee tracking + actuarial budget system.
