  • via Nationalization of PCT : 31 months from earliest priority date.
  • via Validation of European Patent in EPO member states: 3 months from the date of European patent grant

PRH conducts formality examination and substantive examination for invention patents application. In Finland, the substantive examination of patent applications starts automatically without filing a separate request. Generally, it takes 8 months for PRH to issue the first office action, and the applicant needs to reply to the office action within 2-4 months. Application will be granted if the granted requirements are met.

Disclosure of the information about the invention within 6 months before the filing date or priority date does not disprove the novelty of the invention in Finland in the following cases:
- the disclosure resulted from an evident abuse in relation to the applicant or his/her predecessor in title.
- the invention was disclosed at an official or officially recognised international exhibition.

2-2.5 years

  • Grant Fee: The applicant shall pay the granted fee within 2 months after receiving the granted notification.
  • Annuity: The annuity will be paid year by year starting from the 3rd year (including the 1-3 year annuity). The overdue annuity can be paid within a grace period of 6 months. At the same time, 20% of the annuity of the current year is paid as a penalty.

The maximum protection term of a utility model in Finland is 10 years from the filing date. The initial term of protection is 4 years from the filing date, renewable for two further periods of 4 and 2 years. 

  • via Paris Convention : 12 months from earliest priority date.
  • via Nationalization of PCT : 31 months from earliest priority date.

PRH conducts formality examination only. The utility model application is examined for compliance with formal requirements, uniformity and registrability. No examination for the novelty will be conducted. The applicant can file a request for delay in grant within 2 months from the filing date/priority date, and the grant can be delayed for 15 months at the latest.

Disclosure of the information about the invention within 6 months before the filing or priority date does not disprove the novelty of the invention in Finland in the following cases:
- the disclosure resulted from an evident abuse in relation to the applicant or his/her predecessor in title;
- the invention was disclosed at an official or officially recognised international exhibition.

  • Grant Fee: The applicant shall pay the grant fee within 2 months after receiving the grant notice.
  • Annuity: The annuity for the 1-4 years is included in the filing fee. The annuity will be paid from the 5th year and paid once every three years after granted. It must be paid on the last day of the month of the filing date. If the annuity is overdue, it can be paid within a grace period of 6 months, but a penalty of 50.00 euros will be paid.

The validity term of a design registration in Finland is 5 years from the date of filing. On request of the applicant, it can be renewed for further 5-year periods up to a maximum of 25 years. For the design that is a part of a complex product and it is always used to restore the original appearance of the complex product, the maximum term of protection is 15 years from the filing date.

  • via Paris Convention : 6 months from earliest priority date.
  • via Hague System: 6 months from earliest priority date.
  • via EU Community Design: 6 months from the earliest priority date.

PRH conducts formal examination and substantive examination for design application. Substantive examination begins automatically without the need to file a request separately.

The novelty grace period is 12 months before the filing date/priority date.

  • Grant Fee: The applicant shall pay the granted announcement fee within 2 months after receiving the official notification.
  • Annuity: The annuity must be paid within 1 year before the expiration of the current period of validity at the earliest and 6 months after the expiration at the latest.  The overdue annuity can be paid within a grace period of 6 months. At the same time, 20% of the annuity of the current year is paid as a penalty.
