IP fees increase in Portugal

Starting from July 1, 2023, Portugal has implemented a new intellectual property fee schedule, with all fees rising almost across the board by about 8%. The new fee schedule will last until June 30, 2024.

However, if you file electronically in Portugal, the fee can be half of the fee for paper submission:

Patent:

  • According to the revised fee schedule, the fee for filing a Portuguese patent application has increased from €109.07 to €117.93.
  • The annual fee for the 5th year increased from 53.79 euros to 58.16 euros, the annual patent fee for the 10th to 11th years increased from 376.46 euros to 407.03 euros, the annual fees for the 15th to 16th years increased from 591.56 euros to 639.59 euros, and the annual patent fees for the 19th to 20th years increased from 53.79 euros to 58.16 euros. The annual fee rises from €752.90 to €814.04.
  • Fees related to European patents (EP) have also increased. The fees for Portuguese provisional patent protection and EP validity have been adjusted to 58.97 euros respectively, instead of the previous 54.54 euros. The same fees apply for PCT provisional protection and national phase entry.

Appearance design:

  • The basic fee for a Portuguese design application for 5 designs increases from 109.07 euros to 117.93 euros. After the 5th design, the fee for each additional product increases from 10.91 euros to 11.80 euros.
  • The annual design fee increases from EUR 32.72 to EUR 35.38 in the second five-year period and from EUR 65.43 to EUR 70.74 in the fifth five-year period.

trademark:

  • The trademark application fee and trademark renewal fee related to a single class of goods or services increased from 129.08 euros to 139.56 euros, and the fee for each additional class was 35.38 euros, higher than the previous 32.72 euros.
