- via Paris Convention : 12 months from earliest priority date.
- via Nationalization of PCT : 31 months from earliest priority date.
- via Validation of European Patent in EPO member states: within 3 months after the grant of the European patent.
OMPIC conducts formality examination and substantive examination for invention patent applications. The applicant should pay the filing fee and file a search request within 1 month from the filing date. If OMPIC issues notification for formal defects, the applicant must response within 3 months from the issuance date. If no response before the time limit, a request for further processing may be filed. The search report is prepared by the examiner with an opinion on patentability. The applicant will have 3 months to respond to the search report and make amendments to the application. The search report will be published together with the application documents in 18 months from the filing date. Based on the search report and third-party observation, the patent application that finally meets the granted requirements can be granted.

- Grant Fee: The applicant needs to pay the grant fee after receiving the grant notice.
- Annuity: Annuity should be paid from the 2nd year of the filing date and the applicant must pay the subsequent annuity after granted. Earlier payment cannot be allowed. The annuity cannot be paid more than 12 months in advance, either. If overdue, it can be paid within a grace period of 6 months, and 25% of the annuity of the current year is required to be paid as a penalty.
