- via Nationalization of PCT : 31 months from earliest priority date.
- via Paris Convention : 12 months from earliest priority date.
- via Validation of European Patent in EPO member states: within 3 months after the grant of the European patent.
NIPO conducts formality examination and substantive examination for invention patent applications. The substantive examination starts automatically without a separate request from the applicant. The applicant needs to pay the filing fee at the same time as the submission or receive the notice of payment of the filing fee from the NIPO within 10 days from the filing date, and pay the filing fee within 4 weeks from the date of publication. Within 7 months, the applicant will receive the first search report/examination opinion on patentability issued by NIPO, and is required to reply before the due date. No response will lead the application be put on hold. But the application still could be reinstated if the response within 4 months after the deadline. The patent application will be granted if the requirements are met.
If the applicant or its original right holder discloses the information about the invention in an international exhibition recognized by the Bureau International des Expositions (BIE), it shall enjoy a novelty grace period of 6 months before the filing date/priority date.
2.8-3 years
- Grant Fee: The applicant should pay the grant fee within 2 months after receiving the grant notice. If it is overdue, the payment can be postponed within a grace period of 4 months, and a penalty must be paid at the same time.
- Annuity: The annuity should be paid starting from the 3rd year from the filing date, including annual fees for the 1-2 years. Payment can be made within 6 months before the due date. The due date for paying annuities is the last day of the month in which filing occurred. If the annuity is overdue, the payment can be postponed within 6 months after the due date, but a penalty of NOK 700.00 is required.
