Like most other countries in the world, copyright protection in Brazil adopts the principle of automatic protection. According to Article 18 of the Brazilian Copyright Law, copyright protection does not rely on registration. Even so, registration can still provide convenience in terms of ownership proof and enforceability. Brazil is a member of core copyright treaties such as the Berne Convention and the Universal Copyright Convention, so works from member countries are also protected in Brazil without the need for local registration.
Artworks can be registered with the Brazilian Copyright Office, which may be located at the National Library or the Academy of Fine Arts, depending on the nature of the work. The registration process takes about 10 months. Individuals or legal entities can apply. If applying in the name of a legal entity, a work transfer agreement from the creator is required.
Necessary documents:
- Copies of the work: Two physical copies of the work: one signed and notarized by the author, and a second copy of better quality for the certificate
- Proof of author's identity: such as ID card or passport
- Power of attorney: signed and notarized letter of authorization
- Transfer documents: Work transfer agreement signed and notarized by both parties (digital signature needs to be certified by Brazilian ICP)
Approval and Fees:
- Application fee: $800
- Certificate fee: $300
