Ukraine Supplementary Protection Certificate (SPC) Renewal Procedure

On June 9, 2025, Ukraine's "Regulations on the Approval of the Procedure for Applying for Supplementary Protection Rights" officially came into effect, setting out clear regulations for applying for supplementary protection certificates. Such certificates are specifically for inventions involving pharmaceutical products, plant protection products and animal protection products.

Key points of the new procedure include:

• Updated requirements for SPC application writing: clarifying what documents need to be submitted, what information is required, and what demonstrates the existence of existing valid patents and commercialization of the drug.
• The procedure for submitting applications to the relevant authority (UANIPIO) and the time frame for their review.
• The procedure for deciding whether to grant supplementary protection and the possibility for applicants to appeal if they disagree with the refusal decision.
• The conditions and maximum duration of supplementary protection are up to five years after the expiration of the basic patent.
